Under these conditions, Artex.auction, being the owner of the trading platform where he acts as an auctioneer, is called the ” Auctioneer “, the owners of art objects that are sold at the auction are called “Vendors”, and the bidders who participate in bids and purchase art objects are called “Buyers”.
People who have not been registered and have not paid the registration fee are not allowed to participate in the auction.
Although the Auctioneer takes all reasonable steps to ensure the accuracy of the descriptions of the Lots offered for sale, such descriptions are only a statement of the opinion of the Auctioneer and should not be relied upon in disputes or claims. All questions about the Lot should be directed to the Auctioneer or the Vendor prior to making a decision to bid.
The Lot can only be offered by the Auctioneer or the Vendor registered at the auction.
The beginning of the online auction starts at the time set by the Auctioneer or the Vendor and ends at the time set by them. Each Online Auction Lot has a different start and end time for the auction.
Bidding begins with the first bid, where online bidders bid up using the “Bid” button in agreement to purchase the item at a price one step higher than previously announced.
The auction participant who offered the highest price for each Lot after the end of the auction becomes the Buyer and is obliged to pay the goods to the Auctioneer or the Vendor within 3 days.
Property rights to the Lot are transferred to the Buyer only after payment of all payments (the cost of the Lot and the registration fee) in full.
The buyer pays for the purchased lots in the currency of the auction, or in rubles at the exchange rate of the Central Bank of the Russian Federation on the day of the auction.
If the Buyer has not paid in full for any Lot within 3 days of the end of the auction, such Lot may at any time thereafter, at the discretion of the auctioneer, be re-bid at auction or be sold privately.
The Buyer who bids on any Lot hereby confirms that he is satisfied with the physical condition, age and description of such Lot, and also that he accepts these conditions of sale.
Each Lot owned by the Auctioneer and sold to the Buyer at auction will be shipped to the Buyer by the Auctioneer, with shipping costs depending on the Buyer’s location and subject to an additional charge.
Each Lot owned by the Vendor and sold to the Buyer at the auction is sent to the Buyer by the Vendor and is owned by the Vendor until the goods are sent to the Buyer.
The Auctioneer transfers to the Vendor the cost of selling the Lot minus the Auctioneer’s commission and the bank commission for the transfer of funds
Transfer of money to the Vendor’s address is made by the Auctioneer after receiving from the Vendor documents confirming the shipment of the goods to the Buyer’s address.
In the event that no bids have been made on the Lot, the Lot may be put up for new auctions in manual or automatic mode.
The Vendor pays the Auctioneer a commission of 15% of the price of the hammer. The amount of the commission is withheld from the amount due to the Vendor for the sold Lot and is non-refundable in the event of a dispute between the parties.
The Auctioneer acts only as an agent in the sale of any Lot and therefore shall not be liable for any default by the Buyer or Vendor. All claims against the actions of the Buyer or the Vendor should be resolved in the manner prescribed by law.
